Filing for Dissolution in Scotland County

At least one spouse must have lived in Missouri for 90 days to file. Under RSMo 452.305, you file in the circuit court of the county where you or your spouse lives. Scotland County residents file at the Memphis courthouse.

The petition needs the information required by RSMo 452.310: residence of each party, marriage date and place, separation date, names and ages of children, pregnancy status, and last four digits of Social Security numbers. Missouri is no-fault. The only ground needed is that the marriage is irretrievably broken.

After filing, 30 days must pass before the court can finalize the dissolution. Parents with minor children must complete a parent education program. Self-represented parties need to do the litigant awareness program per Missouri Supreme Court Rule 88.09.

The court divides marital property under RSMo 452.330. Missouri uses equitable distribution, which means fair but not always equal. The judge considers each spouse's financial situation, what each contributed, and non-marital assets. Child support is figured using Form 14 under Section 452.340. Support gets reviewed every four years. Custody decisions follow Section 452.375 and the best interests standard. If you cannot afford the filing fee, file an In Forma Pauperis motion with the court.
